Sodomy charge remains

Leonard J. Cook, 31, arrested and charged in October with statutory sodomy in the second-degree, on Wednesday was scheduled for arraignment at 1 p.m. April 7 by the Honorable Associate Circuit Judge Ronald White, who found probable cause existed for the charge against him.

Representing the State of Missouri, Phelps County Prosecuting Attorney Courtney George presented one witness for the prosecution in the preliminary hearing, the alleged victim, Elizabeth Lenox, who was 16-years-of-age at the time of the crime.

Lenox testified Cook sodomized her and that his girlfriend also was present in his apartment at the time. Lenox also testified that she “never told Mr. Cook to stop.”

Cook, arrested in October, was previously employed as an officer at the University of Missouri-Rolla, was applying for a position with the Rolla Police Department when allegations were made which led to a one-week investigation by the Missouri State Highway Patrol Troop I Unit of the Division of Drug and Crime Control (D/DCC).

An investigation was requested by George and the Rolla Police Department on Sept. 24, 2007. The sodomy charges filed against Cook allegedly occurred in 2006.

In a probable cause statement taken during a non-custodial interview, Cook admitted that during the month of November, 2006, he knowingly performed deviate sexual intercourse with a 16-year-old while also having sexual intercourse with a 18-year-old female.

A person commits the crime of statutory sodomy in the second degree if being twenty-one years of age or older, he has deviate sexual intercourse with another person who is less than seventeen years of age.

"Deviate sexual intercourse", any act involving the genitals of one person and the hand, mouth, tongue, or anus of another person or a sexual act involving the penetration, however slight, of the male or female sex organ or the anus by a finger, instrument or object done for the purpose of arousing or gratifying the sexual desire of any person or for the purpose of terrorizing the victim;
