Aparently it is illegal to carry a cudgel, or a spear in North Dakota

62.1-01-01 PDF General definitions. As used in this title, unless the context otherwise requires:


1. "Dangerous weapon" includes any switchblade or gravity knife, machete, scimitar, stiletto, sword, dagger, or knife with a blade of five inches [12.7 centimeters] or more; any throwing star, nunchaku, or other martial arts weapon; any billy, blackjack, sap, bludgeon, cudgel, metal knuckles, or sand club; any slungshot; any bow and arrow, crossbow, or spear; any stun gun; any weapon that will expel, or is readily capable of expelling, a projectile by the action of a spring, compressed air, or compressed gas including any such weapon, loaded or unloaded, commonly referred to as a BB gun, air rifle, or CO2 gun; and any projector of a bomb or any object containing or capable of producing and emitting any noxious liquid, gas, or substance.

There's a reason that the University of Missouri-Rolla is in Missouri and not North Dakota. I'd figured it was mostly just the name, but apparently it's because of St. Pat's too.

That's just defining what is considered a dangerous weapon, not saying you can't carry those things. It's entirely possible that there is another law that says you can't carry a dangerous weapon in public, but that's not included in your post. Either way I fail to see the point, being that we're in Missouri and not North Dakota...

Most states, including Missouri (at least this is my understanding, feel free to correct me), allow you to carry things considered to be dangerous weapons so long as they are not concealed and you are not presenting them in what is considered a threatening way. This is with the exception of firearms, of course.

Many if not most states let you technically carry non concealed firearms so long as they are not "brandished" or "used with intent to intimidate" or "cause public disturbance to order" and the like. It's not usually done because of a lot of the concealed carry legislation that has been passed allowing people to go without the hassle of being confronted by uninformed police officers and citizens questioning them. But in rural areas it's not entirely uncommon to see people out and about with their pistols in visible holsters on their hips. The legal provision is often used more as a form of political protest than a practical tool by gun owners these days. They often hold "open carry" marches or days where they assemble and carry in the open legally to lobby for concealed permits.

each city makes its own laws regarding open carry of firearms. however, many states are making preemptive state laws so that if you have a CCW permit, you can open carry wherever.

Almost all open carry laws predate the concealed carry ones and are applied at a statewide level. Cities can make laws that restrict open carry within their jurisdiction in certain states.

Sticks and maglites would probably be considered dangerous weapons in most states. That's why most places you're allowed to carry a "dangerous weapon," so long as you don't show intent to use it as such.

And cities can only really make firearms laws, or any laws, if the state allows them to do so. I'm not even sure if they're called laws. Aren't they just statutes or something?
